Terms & Conditions.

The rules of the road for using monarchlegacy.tech and any messages, scheduled calls, or services that follow.

§ 01

Agreement to terms.

These Terms & Conditions (“Terms”) form a binding agreement between you and Monarch Consulting (“Monarch,” “we,” “us”), a Maryland-based firm operating monarchlegacy.tech (the “Site”). By visiting the Site, submitting a form, booking a call, opting in to text messages, or otherwise communicating with us, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site or our services.

A separate, signed engagement agreement governs paid client work. If a term in your engagement agreement conflicts with these Terms, the engagement agreement controls for that engagement.

§ 02

Eligibility.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Site, opt in to our SMS program, or enter into an engagement with us. If you’re using the Site on behalf of a business, you represent that you have authority to bind that business to these Terms.

§ 03

Use of the Site.

You agree to use the Site only for lawful purposes and in line with these Terms. You won’t:

  • Attempt to interfere with the security or integrity of the Site (probing, scanning, breaching, or circumventing access controls).
  • Reverse-engineer, scrape at scale, or harvest content for use in a competing service or for training a third-party AI model without our written permission.
  • Submit false, misleading, or fraudulent information through any form.
  • Use the Site to send spam, malware, or otherwise abusive content.
  • Impersonate any person or misrepresent your affiliation with any person or organization.

We may suspend or terminate access to the Site at any time, with or without notice, if we reasonably believe you’ve violated these Terms or applicable law.

§ 04

Intellectual property.

The Site — including its design, layout, copy, code, logos, and accompanying materials — is owned by Monarch or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal or business evaluation purposes. No other rights are granted by implication, estoppel, or otherwise.

“Monarch,” “Monarch Legacy,” “Monarch Consulting,” and the seal mark are trademarks of Monarch Consulting. You may not use them without our written permission.

§ 05

Bookings & engagements.

Booking a call through the Site is an introductory step, not a contract for services. Any work we perform for you is governed by a separate written engagement agreement that defines scope, fees, timeline, and deliverables. Pricing displayed on the Site is indicative and may change; final pricing for your project is the pricing in your signed engagement.

Information you submit through the project intake form is treated confidentially under our Privacy Policy.

§ 06

SMS Program Terms.

This section is the published terms for the SMS messaging program we operate through Twilio. It applies to anyone who provides their mobile number and opts in to receive text messages from us.

Program description

Monarch Legacy SMS Notifications sends transactional text messages to people who have given us their mobile number and opted in. Message types include: booking confirmations, appointment reminders, replies to questions you send us, project intake follow-ups, and engagement status updates. We do not send marketing or promotional texts through this program.

Message frequency

Message frequency varies. Messages are sent only in response to actions you take (booking a call, submitting an intake, replying to a thread) or to confirm or remind you of an appointment.

Message and data rates

Message and data rates may apply. You are responsible for any charges from your wireless carrier for messages sent to or received from us. Check your wireless plan if you’re unsure of those rates.

How to opt in

You can opt in by entering your mobile number in a form on the Site that includes the SMS consent disclosure and checking the consent box, by texting a keyword to a number we publish, or by providing your number to us during a booked call. We retain a record of your opt-in (the date, time, exact opt-in language shown to you, and the channel) so we can demonstrate your consent. Consent to receive messages is not a condition of any purchase.

HELP — getting help

If you are experiencing any issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can get help directly at info@monarchlegacy.tech.

STOP — opting out

You can cancel the SMS service at any time. Just text “STOP” to the number from which you received the message. After you send the message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending messages to you again.

We also honor the keywords END, UNSUBSCRIBE, CANCEL, QUIT, and similar variants, in any case. You can also opt out by emailing us at info@monarchlegacy.tech.

Carriers and delivery

Carriers are not liable for delayed or undelivered messages. We deliver messages through Twilio and the wireless carriers that serve your number; we do not control whether or when carriers deliver each message. Supported carriers include all major U.S. wireless carriers; T-Mobile is not liable for delayed or undelivered messages.

We don’t share your mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information categories described in our Privacy Policy specifically exclude text-messaging originator opt-in data and consent, and that information will not be shared with any third parties. We do not sell, rent, or transfer SMS opt-in lists or consent. Twilio acts solely as a service provider for delivering our messages.

Your consent is specific to Monarch Legacy SMS Notifications. We won’t use it to send unrelated promotional messages or transfer it to anyone else. If we ever introduce a new SMS program, we’ll ask for a separate opt-in.

Age and eligibility

You must be at least 18 years of age, or have the consent of a parent or legal guardian, to subscribe to this messaging program.

Privacy

Use of the SMS program is also governed by our Privacy Policy.

Customer care

§ 07

Email communications.

When you contact us or fill out a form, we may send you transactional emails about your inquiry, booking, or engagement. If you separately opt in to a newsletter or marketing list, every email will identify itself as commercial, include a working unsubscribe link, and include our valid postal address — and we’ll honor unsubscribe requests within 10 business days, as required by the federal CAN-SPAM Act.

§ 08

Third-party services.

The Site may link to third-party websites or rely on third-party services (including, but not limited to, Cal.com for scheduling, Twilio for messaging, our email and analytics providers, and payment processors). We don’t control those services and aren’t responsible for their content, terms, or privacy practices. Your use of those services is governed by their own terms and policies.

§ 09

Disclaimers.

The Site and its content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Monarch disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.

Content on the Site — including pricing, case studies, blog posts, and informational pages — is for general information. It is not legal, tax, financial, accounting, or other professional advice, and you shouldn’t rely on it as a substitute for advice from a qualified professional.

§ 10

Limitation of liability.

To the maximum extent permitted by law, Monarch will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site, the SMS program, or any other service provided through the Site — whether based in contract, tort, statute, or otherwise — even if we’ve been advised of the possibility of such damages.

To the extent any liability cannot be disclaimed, our total aggregate liability for all claims arising out of or related to the Site or your interactions with us through the Site (excluding any signed engagement agreement, which has its own liability terms) is limited to the greater of (a) one hundred U.S. dollars ($100) or (b) amounts actually paid by you to Monarch through the Site in the twelve months preceding the claim.

Some jurisdictions don’t allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply to the maximum extent permitted.

§ 11

Indemnification.

You agree to indemnify and hold Monarch and its officers, members, employees, and contractors harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of (a) your violation of these Terms, (b) your violation of any law or third-party right (including any wireless carrier rule or messaging policy), or (c) information you submit through the Site that is inaccurate or infringes any third-party right.

§ 12

Governing law & disputes.

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-laws principles. The exclusive forum for any dispute arising out of or relating to these Terms or the Site (excluding any signed engagement agreement, which controls for that engagement) is the state or federal courts located in Montgomery County, Maryland, and you consent to personal jurisdiction in those courts.

Nothing in these Terms is intended to limit any rights you may have under the consumer protection laws of your state of residence, including the Maryland Online Data Privacy Act, the Virginia Consumer Data Protection Act, the District of Columbia Consumer Protection Procedures Act, or other applicable consumer protection statutes.

If any provision of these Terms is held unenforceable, the rest will remain in effect. Failure to enforce a provision is not a waiver of our right to enforce it later.

§ 13

Changes to these Terms.

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Effective” date. Your continued use of the Site after the effective date means you accept the updated Terms. If a change materially affects your existing SMS subscription, we’ll notify you and give you a chance to opt out before the change takes effect.
